1. About Privly

Privly is a digital document generation service that creates DPDP Act 2023 compliance templates — including privacy notices, consent text, retention policies, and gap checklists — based on information you provide about your business. Privly also offers a hosted privacy page service that publishes your generated privacy notice at a publicly accessible URL.

2. Not Legal Advice

Privly generates templates based on DPDP Act 2023 requirements. The output does not constitute legal advice and does not create a lawyer-client relationship. You should consult a qualified lawyer before relying on any generated document for compliance purposes. Privly makes no warranty that generated documents will satisfy all requirements applicable to your specific business situation.

3. User Responsibilities

You are responsible for the accuracy and completeness of the information you provide during the intake process. Privly generates documents based on your inputs — if your inputs are incomplete or inaccurate, the generated documents may not reflect your actual data practices. You are responsible for reviewing all generated documents before publishing or relying on them.

4. Payment Terms

Payment is due before document generation begins. Privly currently offers a Starter Pack (₹4,999 one-time) which includes generation of your compliance documents. A hosted privacy page add-on (₹1,999/year) is available as a recurring annual subscription. Additional packs and regenerations can be purchased separately. All prices are inclusive of applicable taxes unless stated otherwise. Payments are processed securely through our payment gateway.

5. Refund and Cancellation Policy

Privly is a digital document generation service. Due to the nature of the service, all payments are processed before document generation begins.

Refund Eligibility:

• If you experience a technical issue that prevents document generation after payment, you are eligible for a full refund. Contact support@privly.in within 7 days of payment with your order details.
• If the generated documents contain errors attributable to our tool (not errors in the information you provided), we will either regenerate your documents at no cost or issue a full refund at your choice.

No Refund Cases:

• Once documents have been successfully generated and delivered, refunds are not available as the service has been fully rendered.
• Refunds are not available for dissatisfaction with document content that results from incomplete or inaccurate information provided during the intake process.

Cancellation:

• You may cancel your order at any time before document generation begins for a full refund.
• Once generation has started, cancellation is not possible as the service is delivered instantly.

Hosted Privacy Page Renewal:

• Annual renewal payments (₹1,999/year) can be cancelled at any time. No refund is provided for the remaining period of an active subscription.
• Upon cancellation or non-renewal, your hosted privacy page will display an expiry notice after the current period ends.

Refund Processing:

Approved refunds will be processed within 5–7 business days to the original payment method.

To request a refund or cancellation, email support@privly.in with your registered email address and order details.

6. Hosted Privacy Page

Your hosted privacy page is active for 1 year from the date of generation. After expiry, the page will display an expiry notice unless renewed. We may update the page template to reflect changes in regulations, but we are not obligated to do so. You remain responsible for ensuring your published privacy notice accurately reflects your current data practices.

7. Regeneration Limits

Each pack includes 2 regenerations at no additional cost. Additional regenerations can be purchased separately. Regeneration allows you to update document content based on revised intake answers but does not allow you to change the core business identity (company name and legal name) associated with the pack.

8. Account and Data

You can request deletion of your account and all associated data by emailing privacy@privly.in. Deletion of your account will deactivate any hosted privacy pages associated with your account. We retain transaction records as required by applicable law.

9. Limitation of Liability

Privly is provided as-is without warranties of any kind. We are not liable for any penalties, fines, regulatory action, or legal consequences arising from the use of generated documents. Our total aggregate liability for any claim arising from your use of Privly is limited to the amount you paid for the specific service giving rise to the claim.

10. Changes to Terms

We may update these terms from time to time. We will update the effective date at the top of this page when we do. Continued use of Privly after changes are posted constitutes your acceptance of the updated terms.
